KAMPALA, January 25, 2024 | The High Court in Kampala has concluded the controversial land dispute between Harriet Rugingana and the National Social Security Fund (NSSF). The legal battle revolved around a parcel of land measuring approximately 0.098 hectares situated at Leasehold Register Volume 3656, Folio 10, Plot 13 along Ismael Road, in the palatial Mbuya suburb, Kampala City.
Hon. Justice Benard Namanya of the Land Division delivered a verdict confirming the National Social Security Fund’s lawful ownership of the land, declaring that Rugingana had no legal claim. The decision followed a careful review of evidence presented by both parties.
Rugingana asserted that her land had been wrongfully included in the certificate of title for the property purchased by the NSSF. On its part, NSSF argued that it had legitimately acquired the land from Rev. Dr. Grace Karamura and Dr. Lydia Karamura, the registered proprietors, after conducting thorough due diligence and vehemently denied any fraudulent activities.
During the trial, Justice Namanya highlighted that Rugingana, during a site visit, identified two residential houses outside the defendant’s perimeter wall as hers. However, she failed to substantiate the boundaries of her alleged land or prove any encroachment. Additionally, the judge dismissed Rugingana’s claim that the NSSF processed a lease certificate of title without inspection by the Area Land Committee.
With this ruling, the National Social Security Fund retains undisputed ownership of the contested land, bringing a resolution to a prolonged legal battle.
