Abitex Cleared of Charges in Freedom City New Year’s Stampede Tragedy

KAMPALA, October 05, 2023 | The Chief Magistrates’ Court at Makindye has dismissed charges against music promoter Abbey Musinguzi, popularly known as Abitex, linked to the New Year’s Day stampede at Freedom City that claimed thirteen lives. The incident, which transpired during a joyous New Year’s celebration, led to a court battle against Abitex and businessman Elvis Francis Jjuuko, the event’s master of ceremonies.

On the night in question, revelers gathered at Freedom City to ring in the New Year. Tragically, the festivities turned fatal when attendees, eager to witness a fireworks display, faced a deadly stampede. Thirteen individuals, including Daniel and Daniella Kibuuka, Ibrahim Kizito, and Viola Nakanwagi, lost their lives in the chaos. The incident sent shockwaves through the nation, prompting legal action against the organizers.

Abitex and Jjuuko found themselves accused of a rash and negligent act allegedly contributing to the stampede. However, Senior Grade One Magistrate Igga Adiru dismissed the charges citing ‘want of prosecution.’ The magistrate’s decision, based on the lack of substantial evidence, marked a vital moment in the legal proceedings. Despite the ruling, the Director of Public Prosecutions retains the option to reinstate the case should new witnesses emerge.

The prosecution’s case centered on the allegation that Musinguzi and others, in the late hours of December 31, 2022, and early hours of January 1, 2023, endangered lives by limiting venue exits. This alleged action resulted in a perilous situation as thousands of attendees attempted to exit through a single gate, leading to the fatal stampede.
